This Contract of Sale is between Charlene E. Hohl (hereinafter "SELLER") and (hereinafter "BUYER".)

The aforementioned puppy is a purebred Standard Poodle, sired by Jem’s Majestic Flash, and whelped by the dam Hohl’s Lucy Midnight Joy. Registration papers with AKC Limited Registration will be provided as set fort in this contract.
BUYER AND SELLER AGREE TO THE FOLLOWING PROVISIONS OF THE SALE:
SELLER makes the following assertions at the time of BUYER taking possession of the dog:
1. The dog is in good health, free of known contagious diseases and has had vaccinations required for its age at the time of this agreement.
2. The dog has had a physical examination performed by a qualified veterinarian. BUYER agrees to have the dog examined by a licensed veterinarian within 10 days of receipt of the puppy. BUYER understands that a copy of the health certificate issued by the BUYER’S veterinarian must be immediately mailed to the SELLER. If the puppy is in anything, but “Good Health” due to disease only (not injury or mishandling), as evidenced by a veterinarian's statement, BUYER can elect to keep the dog, assuming all costs for its care, or may return the dog for a full refund upon SELLER’S receipt of the veterinarian's statement regarding the puppy's health. This provision will expire 12 days after BUYER takes possession of the dog. All monies, except the non-refundable deposit, will be returned at the time of the return of the puppy to the SELLER within the 12 day period, provided that a Veterinarian Certificate is presented to the seller. NO TREATMENT IS AUTHORIZED. If any treatment is rendered, this guarantee is NOT VALID.
BUYER certifies by signing this agreement that the dog will live with BUYER, will have adequate exercise, nutritious food and necessary health care from a licensed Veterinarian, BUYER also certifies, by signing this agreement, that he/she is not acting as a agent in this purchase; that the BUYER will not sell this puppy to a pet store, kennel, guard dog business or a medical research facility.
SELLER asserts and SELLER makes no guarantee regarding loss of the dog because of accidental death, theft, sickness, etc., or any other loss beyond SELLER’S control. If the dog develops hip dysphasia or genetic defects within 12 months from the date of birth, BUYER may return the dog to the SELLER for a replacement puppy of equal quality, selected by the SELLER, if and when the SELLER has the next litter of puppies. SELLER reserves the right to have her veterinarian or one of her choice evaluate the dog's condition before the warranty will be honored. BUYER may elect to keep the dog. Under no conditions and at no time during the life of the dog will SELLER pay or assist in paying veterinary expenses after the dog is purchased, including any such expense directly or indirectly related to any inheritable/genetic defects.
*BUYER understands that if the puppy should die within 12 days of purchase date, the puppy must be returned to the SELLER to receive a necropsy. If due to breeding, puppy will be replaced.
BUYER understands that payment is due at the time buyer takes possession of the dog or, if being shipped, prior to shipping date. Balance of purchase price is to be paid in cash or by U.S. Postal Money Order unless otherwise agreed upon.
The dog is being sold on a spay/neuter contract (unless breeding rights have been arranged ahead of time), with spay/neuter being required no later than the age of 6 months. Registration papers will be provided after proof of spay/neuter is provided to the SELLER.
The sales contract is non-transferable. Should BUYER relinquish ownership of the dog, for any reason, this Contract of Sale shall be deemed null and void.
In the event the BUYER is unable to keep the dog for any reason, the BUYER agrees to immediately return the puppy back to the breeder without financial restitution.
BUYER agrees to send updated photos of the aforementioned puppy every calendar quarter for the first year after purchase date and at least once a year thereafter for the duration of the puppy’s life.
